To the Malta Gaming Authority,
I am writing to file a formal complaint against TSG Interactive Gaming Europe Limited (PokerStars), regarding their refusal to erase my personal data after a period of prolonged inactivity exceeding six years.
My account has been inactive, with no logins or financial transactions, for over 6 years. Recently, I requested the erasure of my personal data under Article 17 of the GDPR. PokerStars denied this request, claiming they must retain my data for "licensing and regulatory purposes."
I find this refusal unlawful for the following reasons:
Storage Limitation: Under GDPR Article 5(1)(e), data should not be kept longer than necessary. A period of 6 years of inactivity is well beyond the standard 5-year retention period usually required by AML (Anti-Money Laundering) regulations.
Bad Faith Retention: PokerStars only officially closed my account upon my request for erasure. They now appear to use this new closure date to restart a retention period, effectively circumventing my right to be forgotten.
Proportionality: Keeping sensitive identification documents and financial history for over half a decade without any player activity is disproportionate and violates the principles of the MGA’s own Player Protection Regulations.
I have already contacted their Data Protection Officer, but they provided only a generic template response.
I request the MGA to:
Investigate why TSG Interactive Gaming Europe Limited is retaining data of inactive players for longer than 6 years.
Instruct the operator to proceed with the full erasure of my personal data, as the legal necessity for retention has expired.

Based on extensive documentation and transaction records, I have identified a recurring pattern where players’ funds are transferred through intermediary payment structures and ultimately lost to casinos that, while claiming MGA authorization, operate in ways that undermine consumer protection, transparency, and basic financial safeguards.
In practice, MGA-licensed casinos continue to:
- accept player funds while obstructing or denying withdrawals,
-rely on opaque payment intermediaries and third-party accounts,
-operate in clear conflict with consumer protection principles applicable within the European Union.
Despite repeated public complaints, reports, and documented financial harm, the MGA continues to license and supervise operators whose conduct would not be tolerated under stricter regulatory regimes. This creates the perception that an MGA license is being used as a shield to legitimize practices that effectively deprive consumers of their money.
I consider this a "systemic regulatory failure", where the licensing authority does not provide meaningful protection to players, nor effective remedies once harm has occurred. The result is that consumers are left without real recourse while operators continue business as usual under MGA supervision.
For this reason, I strongly recommend that affected consumers "do not rely on the Malta Gaming Authority for dispute resolution", but instead file formal complaints with the "European Consumer Centre (ECC)" and relevant national authorities. Cross-border consumer protection mechanisms offer significantly stronger safeguards than those currently enforced by the MGA.

I filed a full complaint with the Malta Gaming Authority months ago.
No reply.
Not a single update.
Not even a confirmation that my case exists.
I submitted the complaint again.
Still complete silence.
The worst part isn’t only the stolen money — it’s the feeling of standing completely alone against a system that seems designed to protect the casino, not the player.
It genuinely feels like mafia tactics: take the money, disappear, and pretend you don’t hear the victim screaming for help.
€9,000 is a life-changing amount for a family.
It represents months of work, stress, sacrifices, and responsibility.
Being ignored by both the casino and the regulator is heartbreaking. It destroys trust. It destroys hope.
I’m writing this so others won’t fall into the same nightmare.
If this is how XLBet and the Maltese regulatory system treat people, the world deserves to know.

I asked for my account to be closed only to find out it wasn't. Told me it can only be done if there is a problem gambling. I filed complaint but they refused to deal with me after being unable to show me where in their terms and conditions this rule was written. I thrn contacted mga as I was told by ecogra that this was their issue as holder of the gaming licence first they came back with a completely irrelevant answer so I asked again to answer me regarding my complaint issues. They then replied weeks later that the case has been concluded and the vendor contacted but they didn't tell me the result nor have they updated the vendor. Meanwhile leovegas then told me I can close an account without any gambling issues, my account cannot be reopened once this has been requested and there is no explicit rule outlining any exact reasons for why the account has to be closed based on problem with gambling

Casinos on the other hand, can behave as they want. With them always winning the case and with the time it takes MGA to handle cases, they just need to sit down and ignore the players problems.
I would strongly advice everyone to stay away from MGA casinos.

European Comission must investigate them - did already a report to our contry's EU Commissioner who promised to take this matter. MGA do not handle complaints properly and there is lots of corruption inside them.

Two facts I must divulge.
One I have never had direct interaction although I do interact with several of the sites that are said to be insured by them.
Two since I have not interacted with them personally, I can not say they are a terrible company. Or that they have done any wrong to me. That being said
I would have liked to be able to come here and see a reply from them. Some reassurance that they are watching. Since they are the authority to much of the online gambling/casino world. So we can know and have faith that the casino games we play on line are not just blowing smoke up our rears.
I mean are they even aware of the issues a large percent of people trying to withdraw their winnings are being hassled or scrutinized to the point of defeat.
I may not spend a lot of money buying worthless Internet money. But it is my money. I figure I'm also investing in these sites the win is my return even if it is four to six months down the road.
When it comes back to me.
But if I can't have it back in the form of cash, instead of gift cards to higher end stores. It's not worth it. I mean come on!
